CHRISTINA: THIS CBD ADVISORY — THIS IS A COPY OF THE NOTICE SENT OUT. IT CAN IMPACT A LOT OF BUSINESSES, INCLUDING THIS ONE THAT I AM STANDING IN FRONT OF. THERE’S NO WORD ON HOW LONG IT IS EXPECTED TO LAST. I CAN TELL YOU IT WILL COME DOWN TO 2 DECIDING FACTORS, ONE BEING ATTORNEY GENERAL. >> WE HAVE A REALLY BIG BACKING AND SUPPORT. CHRISTINA: CRYSTAL NUGENT SAYS SHE’S SEEN A LOT OF SUCCESS SINCE SHE OPENED YOUR CBD STORE IN JULY 2018. SHE SELLS EVERYTHING FROM WATER SOLUBLE. >> IT’S ONE OF OUR BIGGEST SELLERS. AS WELL AS OUR TOPICAL RELIEF CREAM. CHRISTINA: EVEN CBD OIL PRODUCTS FOR DOGS. >> THESE PRODUCTS ARE JUST PUT IN YOUR BODY AS A BALANCE. SO, WHEN YOUR BODY IS NOT BALANCED, THE IDEA IS THAT YOUR BODY IS GOING TO DO WHAT IT’S ALREADY SENT OUT TO DO. CHRISTINA: BUT THE ALCOHOL AND TOBACCO CONTROL’S RECENT CRACKDOWN ON CBD OIL PRODUCTS COULD PUT BUSINESSES LIKE NUGENT’S IN JEOPARDY. >> I’M JUST SHOCKED THAT THEY’RE MISCATEGORIZING IT. CHRISTINA: THE STATE’S FARM BILL SAYS CBD OIL IS LEGAL IF IT HAS LESS THAN.3% THC, WHICH IS THE CHEMICAL THAT CAN GET YOU HIGH. BUT ON FRIDAY THE ATC MADE IT CLEAR IN THIS CEASE AND DESIST THAT THE STATE LAW MAKES IT ILLEGAL TO SELL ANY PRODUCTS EXTRACTED FROM A MARIJUANA PLANT. AND IF SALES CONTINUE RIGHT NOW , THE ATC SAYS AGENTS WILL ISSUE CITATIONS. >> WE CARRY ZERO THC IN OUR STORE JUST FOR THIS VERY REASON. WE DON’T WANT TO BE MISCATERGORIZED. CHRISTINA: THE AGENCY IS ALSO WAITING TO HEAR THE ATTORNEY GENERAL’S OPINION ON THE POSSIBLE CONFLICT OF LAWS. IN A STATEMENT, THE AG’S OFFICE TOLD US “WE ARE AWARE OF PROPOSED LEGISLATION THIS SESSION TO ADDRESS THE ISSUE AND WILL RESERVE COMMENT UNTIL THE APPROPRIATE TIME.” IMPORTANT TO NOTE THE ATC SAYS IT WILL CONTINUE TO PROCESS ANY CBD STORE APPLICATIONS THAT ARE PENDING. BUT WILL NOT ISSUE PERMITS UNTIL THEY GET A FULL OPINION FROM THE ATTORNEY GENERAL.
