Senate Bill 57 lays out, in no uncertain terms, the difference between hemp, hemp products, and marijuana. It essentially states that to be considered a hemp product, it must not exceed a THC concentration of 0.3%.
This brings Ohio in line with many other US states (and countries worldwide) where hemp-derived CBD oil is now legal.
While CBD oil products are now legal in Ohio, recreational marijuana use remains illegal. Possession of up to 100 grams of marijuana is considered a minor misdemeanor and carries a maximum fine of $150. Possession of more than 100 grams â€“ but less than 200 grams â€“ of marijuana is a misdemeanor punishable by up to thirty days in jail and a $250 fine.
The decision to limit CBD oil products to only state-licensed dispensaries was taken by the Ohio State Board of Pharmacy. When the new legislation was signed into law in 2019, they released a statement clarifying that hemp products (including CBD hemp oil) could now be legally sold and purchased outside of these dispensaries in Ohio.
